General Terms and Conditions (AGB)

This is an English translation for convenience. The German version is legally binding. German version: Allgemeine Geschäftsbedingungen

Last updated: 29 October 2026 · Version 2026-10-30

§ 1 Scope, provider

(1) These Terms apply to all services of Human Mailbox (“Provider”), operated by Daniel Diegel, Eichengrund 10, 71397 Leutenbach, via the website humanmailbox.com, the API and the MCP server.

(2) Deviating terms and conditions of the Customer apply only if the Provider expressly agrees to them in text form.

§ 2 Contracting party, role of the AI agent

(1) The contracting party (“Customer”) is the natural or legal person who operates the AI agent and is named as the operator (“operator”) during registration. The AI agent itself is not a party to the contract; it acts as the Customer’s messenger or representative.

(2) All declarations, orders and payments made via the Customer’s API key or agent are attributed to the Customer. The Customer keeps their API key secret and informs the Provider without undue delay in the event of misuse.

(3) The contract is concluded upon registration via the API, in the course of which the agent accepts these Terms on behalf of the Customer (accept_terms: true). If an operator is named, they confirm their email address via the link sent to them; the Provider performs forwarding and courier deliveries for them only after this confirmation.

(4) The information provided during registration must be true and complete and must be kept up to date. Disposable email addresses are not permitted.

(4a) A mailbox can also be registered without naming an operator (“mailbox without operator”). The Customer is then the natural or legal person who actually operates the AI agent or controls its API key, even if they are not named; paragraph (2) applies. The following limits apply to such mailboxes: payments of at most €250 per calendar month, at most 20 forwarding or courier orders per calendar month, and only letters and documents are forwarded — parcels and goods are not (they can be opened and scanned, returned to the sender or disposed of). The name chosen for the mail (address_name) must not imitate a company, brand, bank, authority or real person; the Provider may refuse such names and block mailboxes that use them. The limits end once an operator is named and their email address is confirmed (paragraph (3)).

(5) The offer is directed at businesses and consumers. If the Customer is a consumer (§ 13 BGB), they have a right of withdrawal in accordance with § 14. By accepting these Terms (accept_terms: true), the Customer expressly requests that the Provider begin its services immediately and before the withdrawal period expires, and confirms their knowledge that their right of withdrawal expires upon complete performance of the contract by the Provider.

§ 3 Services

(1) The Provider provides a receiving address in Germany with a personal mailbox code and accepts letters and parcels addressed to this address with the mailbox code.

(2) Every incoming item is recorded and photographed from the outside. Once it has been paid for (§ 7(3)), it is opened and its contents are scanned or photographed, depending on the Customer’s choice
a) within three business days of arrival (standard, included in the item price),
b) on the day of arrival for a surcharge (“Same-Day”), provided the item arrives on a business day, or
c) not at all (“never”): the item remains sealed until the Customer instructs otherwise.
The Customer makes this choice for their mailbox (open_policy) or for an announced item (open_mode).

(3) Business days within the meaning of these Terms are Monday to Friday, excluding statutory public holidays in Germany and statutory public holidays in the state of Baden-Württemberg. The time in Germany (Europe/Berlin) is decisive.

(4) On instruction, the Provider also performs: forwarding by post or parcel service (also as express), personal delivery or delivery by courier, return to the sender, destruction, and other agreed activities.

(4a) Further services (on instruction via POST /v1/requests):
a) Sending letters (send_letter): the Provider prints a letter transmitted by the Customer as text or PDF in black and white, puts it in an envelope, franks it and hands it to a postal service, on request as registered mail. The Customer is solely responsible for the content; the Provider does not check it legally, but may refuse letters that are evidently unlawful, threatening, harassing, advertising without consent or sent in bulk. The Provider does not sign anything on the Customer’s behalf.
b) Returns and shipping (ship_out): the Provider packs goods held for the Customer, prints a label supplied by the Customer or buys postage, hands the parcel over and passes on the tracking data.
c) Digitizing (digitize): the Provider photographs or scans receipts, QR codes, product labels, serial numbers or documents of an item and returns the result as a photo, PDF or structured data. The Provider transcribes carefully but does not guarantee the completeness or correctness of transcribed data.
d) Purchases (buy_voucher, buy_item): the Provider buys permitted gift cards, vouchers, prepaid products or goods that are only available locally or by post, in its own name for the Customer’s account, after the Customer has accepted a quote (purchase price plus fee). Purchases are only available to Customers with a named operator and a confirmed email address, up to €100 per voucher, €250 of vouchers per calendar month and €500 per purchase. The Provider does not buy anything to get around identity checks, age checks, purchase limits, sanctions or the terms of a seller, nothing for persons who are evidently being pressured or deceived, and nothing listed in § 4. Codes are placed in the code vault (§ 7a) without a reveal fee; goods are treated like incoming items. Warranty claims against the seller are passed on to the Customer on request; the Provider is not liable for the seller’s performance.
The Provider performs only services connected with mail, addresses, documents, parcels and purchases; it does not make phone calls, test products or run general errands.

(5) Express forwarding: An item instructed as express is handed over to the carrier on the same day if it is at the Provider’s premises before 14:00 on a business day and the order has been placed by then. If an item booked as express in advance only arrives after this time, it is dispatched on the next business day and the express surcharge is refunded to the balance. The Provider gives no guarantee for the carrier’s transit times.

(6) Sender details: If the Customer specifies sender details for a forwarding or return, these must designate the Customer themself or their company. The Provider does not use third-party sender details or misleading details; in that case it may use its own address or no sender details.

(7) Services are performed by a human. Beyond paragraphs 2 and 5, fixed processing times are not owed unless expressly agreed.

(8) The Provider is not obliged to accept items that require a signature with identity verification, cash on delivery or payment on delivery. For forwarded items, the terms and conditions of the commissioned carrier also apply.

(9) Items without a recognisable mailbox code or with an unknown mailbox code are kept and, if they cannot be assigned to a customer, returned to the sender or refused.

§ 4 Excluded items

(1) The following, in particular, are not accepted or not processed:

(2) The Customer ensures that no excluded items are sent to their mailbox code.

§ 5 Rights of the Provider in case of suspicion

(1) The Provider may refuse acceptance, return items, reject an order or open an item if there are indications of a violation of § 4 or of a danger. The Customer is informed of this via the API.

(2) If criminal acts are suspected, the Provider may withhold items, inform the authorities and hand over items and the associated data to them.

(3) The Provider may block or pause accounts if the Customer violates these Terms or misuse is to be feared.

§ 5a Confidentiality, contents

(1) The contents of the items as well as scans, photos and all information derived from them belong solely to the Customer. The Provider uses them exclusively to perform the commissioned services.

(2) The Provider is obliged to maintain confidentiality about contents of and information from items, also after the end of the contract. This does not apply to statutory duties to provide information and to cooperate, or to cases under § 5(2).

§ 6 Storage

(1) Every item is stored for four weeks (28 days) from arrival; this is included in the item price and also applies to items that are waiting unopened due to lack of payment.

(2) No later than seven days before the period expires, the Provider notifies the Customer of this via the API or the webhook (item.expiring).

(3) If the Customer has not given any instruction regarding the item by the time the period expires, the item and its contents are disposed of. The Provider determines the method of disposal; documents are destroyed in a data-protection-compliant manner. Thereafter there is no claim to surrender or to compensation for its value. § 7a applies to codes that have been read in.

(4) Scans and photos remain retrievable via the API for 90 days after the period expires and are then deleted (see Privacy Policy).

§ 7 Prices, balance and payment

(1) The prices in euros retrievable via GET /v1/prices at the time the item arrives or the order is placed apply, or the offer named by the Provider and accepted by the Customer. The Provider may change the prices for future items and orders; letter credits already purchased retain their scope of service. Pursuant to § 19 German VAT Act (UStG), no VAT is charged (small business regulation).

(1a) Mailbox fee: The mailbox (receiving address, recording, photo of the outside, notification, storage) costs the monthly fee stated in GET /v1/prices per 30 days. The first period starts when the Customer first retrieves the street address and is charged from the balance (or paid via x402) at that time. It renews automatically for further 30 days and is charged from the balance; the Customer can end the renewal at any time (POST /v1/subscription/cancel) with effect from the end of the period already paid. If the balance does not cover a renewal, the address remains usable for 14 days; afterwards the Provider may return incoming items to the sender.

(2) Item price: Every incoming item costs one letter price (parcel: three letter prices). It covers acceptance, recording, a photo of the outside, opening and scanning in accordance with § 3(2)(a) and storage in accordance with § 6(1). Opening on the day of arrival costs a surcharge.

(3) Letter credits: The Customer may purchase letter credits and Same-Day credits in bundles in advance. Incoming items are paid for first with letter credits (letter 1, parcel 3), otherwise from the money balance. If neither is sufficient, the item is recorded and photographed but only opened once it has been paid for; later top-ups or bundle purchases are automatically used for this.

(4) No expiry: Letter credits and Same-Day credits do not expire.

(5) Forwarding and return: The handling fee and, where applicable, the express surcharge become due when the order is placed. Postage is charged at cost after weighing; up to the maximum amount specified by the Customer (max_postage_eur) it is debited automatically, above that only after acceptance by the Customer. Postage, customs duties, import levies and third-party fees incurred for the Customer’s items are borne by the Customer.

(6) Payment methods: Payments are possible via x402 (USDC), Bitcoin or PayPal, in each case directly or as a top-up of a balance. For x402 payments, the euro price is converted into USDC at the current EUR/USD exchange rate; the amount is displayed before payment. For Bitcoin, the rate fixed when the payment request is created applies until it expires. The amount actually received is decisive.

(7) Balance is used for the Provider’s services and does not bear interest. For rejected orders and for orders cancelled before processing has begun, the amount paid is credited to the balance (Same-Day credits as Same-Day credits).

(8) Invoices: An invoice is only issued at the Customer’s express request (POST /v1/invoices or MCP request_invoice), free of charge, for the specified payments or for all payments not yet invoiced, and sent by email to the specified address or to the address on file. Without a request, no invoice is issued or sent. The Customer is responsible for the correctness of the invoice details (name, address, VAT ID number).

(9) Money balance is paid out only upon termination of the contract at the Customer’s request, less any payment and transaction fees incurred, to a means of payment determined by the Provider. The Customer settles a negative balance (e.g. due to customs duties incurred subsequently) without undue delay.

§ 7a Voucher and access codes

(1) If an item contains voucher, gift card or comparable codes, the Provider reads them in and stores them encrypted in the Customer’s mailbox (“code vault”). The Customer is informed via the API or the webhook (codes.ready) that codes are ready for retrieval.

(2) Retrieving a code costs the fee per code stated in GET /v1/prices (currently EUR 1). If the Customer has enabled automatic delivery (auto_reveal_codes), codes are charged on arrival and transmitted immediately, insofar as the balance is sufficient.

(3) If the Customer does not retrieve a code within 24 months of it being made available, the Customer’s claim to retrieval lapses; the code is no longer made available thereafter. The physical carrier (card, insert) is treated in accordance with § 6.

(4) The Provider checks neither the validity nor the value of the codes and is not liable for a code being redeemable.

§ 8 Liability

(1) The Provider is liable without limitation for intent and gross negligence, for injury to life, body or health, and under the Product Liability Act (Produkthaftungsgesetz).

(2) In the case of slight negligence, the Provider is liable only for breach of an essential contractual obligation and limited to the foreseeable damage typical for the contract. For loss of or damage to an item, liability in this case is limited to EUR 100 per item, unless a higher declared value was agreed before arrival.

(3) For loss, damage or delay caused by carriers, the Provider is not liable beyond the claims it itself has against the carrier; it will assign these claims to the Customer on request.

(4) The Provider is not liable for deadlines linked to the receipt of an item (e.g. official or court deadlines), unless it has culpably delayed recording the receipt. If an item is waiting unopened due to lack of payment (§ 7(3)), this lies within the Customer’s sphere of responsibility. The Customer checks incoming mail regularly via the API.

§ 9 Obligations of the Customer and indemnification

The Customer indemnifies the Provider against third-party claims and costs (including reasonable costs of legal action) arising from excluded items being sent to the Customer’s mailbox code, from the Customer specifying incorrect sender details, or from the Customer’s agent using the service unlawfully, insofar as the Customer is responsible for this.

§ 10 Term and termination

(1) The contract runs for an indefinite period and may be terminated by either party at any time in text form (also via POST /v1/messages). The right to terminate without notice for good cause remains unaffected.

(2) Items still present after the end of the contract are forwarded according to the Customer’s instructions at the Customer’s expense or treated in accordance with § 6(3).

§ 11 Data protection

The Privacy Policy applies.

§ 12 Changes to these Terms

The Provider may amend these Terms with effect for the future. Changes are announced at least four weeks in advance via the API (field terms_version) or by email. If the Customer does not object before they take effect, the changes are deemed accepted; the announcement will point out this consequence. With respect to consumers, changes affecting prices or the scope of the main services only take effect with their express consent.

§ 13 Final provisions

(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of the protection of mandatory provisions of the law of the state of their habitual residence.

(2) If the Customer is a merchant, a legal entity under public law, or has no general place of jurisdiction in Germany, the place of jurisdiction is the Provider’s place of business (Leutenbach).

(3) Should individual provisions be invalid, the remainder of the contract remains valid.

§ 14 Information on withdrawal for consumers

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day the contract is concluded.

To exercise your right of withdrawal, you must inform us (Daniel Diegel, Eichengrund 10, 71397 Leutenbach, email: human@humanmailbox.com) of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post, an email or a message via POST /v1/messages). You may use the attached model withdrawal form, but this is not mandatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you without undue delay and in any event not later than fourteen days from the day on which we receive the notice of your withdrawal from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

If you requested that the services begin during the withdrawal period, you shall pay us a reasonable amount which corresponds to the proportion of the services already provided up to the time you inform us of the exercise of the right of withdrawal with regard to this contract, in comparison with the full scope of the services provided for in the contract.

Expiry of the right of withdrawal

In the case of a contract for the provision of services, the right of withdrawal expires when we have provided the service in full and only began performance after you gave your express consent and at the same time confirmed your knowledge that you lose your right of withdrawal upon complete performance of the contract by us.
